Durable Powers of Attorney
Don’t Wait Until It’s Too Late!

Durable Power of Attorney for Financial Matters
You probably have put a lot of thought and effort over the years into protecting your hard-earned money so it will be there when you need it. It only makes sense to make sure you and your money are protected by selecting someone you trust to carry out your financial plans should you become unable to do so.  

A General Durable Power of Attorney for Finances is a document that names a person (your Attorney-in-Fact) to manage your financial affairs.  It does not take away your authority to act while you are capable of making decisions.

A General Durable Power of Attorney for Finances authorizes a person you trust to:

  • Handle general financial matters such as mortgages or other payments
  • Administer yearly tax filings (both State and Federal)
  • Maintain all bank accounts
  • Make payments to Long-Term Care facilities or in-home caregivers
  • Provide the necessary authority to implement Medicaid Asset Preservation Strategies® to protect you and your assets and qualify for government Long-Term Care benefits

And, importantly, a good General Durable Power of Attorney avoids a State Guardianship should you become incapacitated. Because your Attorney-in-Fact has the authority to manage your financial decisions if you cannot, this person should be someone you trust implicitly to follow your wishes and look out for your best interests.  You should talk with the person you want to name as your Attorney-in-Fact to ensure he or she understands your wishes and their duties.

While everyone hopes they will never need someone to act on their behalf, a Durable Power of Attorney for Finances is an essential lifetime Estate Planning document. If you were to become incapacitated and unable to manage your financial affairs, the court will appoint a Guardian if you do not have an effective Durable Power of Attorney for Finances. The Guardianship process is intrusive, expensive, and nearly a complete loss of your rights. Avoid a Guardianship with a good, effective Durable Power of Attorney.
